GENERAL TERMS AND CONDITIONS

  • This program/ scheme is applicable only for customers of Canon India Private Limited (CIPL) who are the owners of EOS-1DX Mark II, EOS 5D Mark IV, EOS 5DS R , EOS 5DS or EOS 6D Mark II , which has been imported and marketed by CIPL (“Products”) and which has been purchased until 31st of May 2018, provided the Products are still under respective standard warranty period (1 year) as well as for the products purchased from 1st June 2018 until 30th November 2018 (both days inclusive) (hereinafter for brevity referred to as “Customers, You, Your”).
  • This Program is valid only in India.
  • You should be a resident of India and of 18 years and above age to participate in this program/scheme.
  • This program/scheme is not open to any counterfeit/second hand product, or product obtained by the customer without a commercially valid invoice.
  • CIPL shall verify the genuineness of the Products by checking the Product Serial Number with its records.
  • To avail the benefits of the program, the products should be covered under standard warranty terms and conditions.
  • You may register for the program/scheme by registering at https://edge.canon.co.in/clubelite (“microsite”). At the time of registration, you will have to submit a completed registration form (the “Registration Form”) available on the microsite and upload the documents stipulated in the Registration Form namely Invoice, with product Serial no., Product Warranty Card and Government approved Photo ID proof such as Aadhar Card, Passport, PAN card, and Driving License. 
  • The registration for the program/scheme is open from 1st June until 30th June 2018 (both days inclusive) for the existing customers who have purchased the Products until 31st of May 2018 provided the Products are still under standard warranty period (1 year).
  • This program/scheme is also available to those Customers who have purchased the products from 1st June 2018 until 30th November 2018 (both days inclusive) where the Customers have to register their products within 30 days from the date of purchase of the Products.
  • CIPL may consider your registration for the program/scheme after verifying the registration form.
  • Acceptance by you of terms & conditions of the program/ scheme is mandatory for participating in this program/scheme.
  • CIPL may, at its sole discretion, decide whether or not to accept your registration for the program/scheme. Your participation in the program/scheme will be subject to the terms and conditions of the program/scheme, which may be amended from time to time by CIPL at its sole discretion. CIPL will send you these amended terms and conditions from time to time in force.
  • CIPL may at its sole discretion appoint a third party service provider (“Authorised Service Provider”) to facilitate the execution including transactions and communications pertaining to the program/scheme.
  • Your participation in the program/ scheme will commence from the date your registration form is approved by CIPL. CIPL shall send an email confirmation to your registered Email address, (which has been provided by you at the time of registration for the program/scheme) confirming your membership to the program/scheme once your registration form is approved. Your membership will continue for a period of one year only from the date of said approval. CIPL will issue a membership card within 30 days from the date of approval of your registration for the program/scheme. CIPL may terminate your Membership at any time without cause and with immediate effect by giving you written notice of termination.
  • Your Membership may be renewed annually at CIPL’s sole discretion upon submission of Renewal Registration Form and on the payment of renewal fees as decided by CIPL which shall be mentioned in the Renewal Registration Form made available on the microsite. CIPL may terminate your Membership during renewal period at any time in case of any breach by you of the terms and condition of this program/ scheme. . Neither termination nor expiration of your Membership shall affect any of your accrued obligations under the program/scheme.
  • The Membership Card issued to you by CIPL will remain the property of CIPL at all times. You must (a) keep the Membership Card safe and secure at all times and return upon termination or discontinuation of your membership of the program/scheme, (b) promptly report any loss or theft of the Membership Card to CIPL; In case of loss or theft of the Membership card, CIPL reserves the right to charge you a reasonable fee as it deems fit for the replacement of your Membership Card.
  • The benefits provided to you in respect of your Membership for the program/scheme will at all times be at the sole discretion of CIPL.
  • The benefits extended to you as a member under the Program/Scheme:
    (a) are personal to you and such benefits and your obligations and rights under the program/scheme can not be assigned or transferred by you under any circumstances ,
    (b) shall only be availed upon the production membership Card with the CIPL authorized representatives and such other personal identification as CIPL may in its sole discretion require, and will only be provided to the Customer identified by the relevant membership Card and personal identification document so produced, and
    (c) will only apply to the Products listed by you in the Registration Form.
  • The benefits offered by CIPL under the Program/scheme shall as follows:
    • 3 days priority walk in repair service facility available only on the Product body (and not on lenses) at the Master Service Centers situated in Delhi, Mumbai, Chennai, Cochin, Bengalaru and Kolkata. Alternatively , in case repair of the product require extra time , the an equivalent standby Product body (and not lens) will be provided to the Customer for use which shall not be brand new Product body but having similar specifications, on returnable basis during the repair service period.
      • CIPL shall not be responsible for any courier facility and the customer shall have to walk in to the above Master Service Centers to avail the benefits of the program/scheme.
      • The 3 day priority walk in repair service time will commence from the same day the product(s) is received by the respective Master Service Center if it is received before 1 pm and from the next day if the product is received by the respective Master Service center after 1pm.
    • For EOS 1DX Mark II New customers –( who purchased EOS 1DX Mark II after 16th April, 2018) - One C Fast memory card of 128GB.  
    • Camera backpack- The dispatch of the Camera backpack to the Customer who are the member under this program/ scheme will start from 1st September 2018
    •  For EOS 5D mark IV, 5DS and 5DSR Customer who are the member under this program/ scheme – One Battery Grip and one CF memory card of 64GB. The dispatch of the Battery Grip and CF memory card will start from 1st September 2018.
    • For EOS 6D Mark II Customer who are the member under this program/ scheme- One SD Card of 64 GB , the dispatch of the same will start from 1st September 2018 .
    • Photography workshop or User Meet for one time during the membership period of 1 year for all the customers who avail the membership under the program/scheme.
    • Discount of 30 % on the labour charge and on the spare parts cost in a manner set out below:
      • Available on each unit of EOS 1DX Mark II body and upto 2 units of L-series lenses as added by the customer at the time of registration
      • Available on each unit of EOS 5D mark IV, 5DS and 5DSR and upto 1 unit of L-series lens as added by the customer at the time of registration
    • Customers cannot avail the benefits mentioned under (ii), (iii), (iv) and (v) during the renewal period of the Program / scheme, as the same can be availed once at the time of successful registration of his/ her membership. Also the benefits mentioned under (ii), (iii), (iv) and (v) can be availed only once at the time of registering its first Product for the membership and thereafter for any subsequent/ multiple products of the same member.
  • If any Stand-by Product body is offered to you for use by CIPL on returnable basis under the program/scheme, then such stand-by Product body will be subject to;

    (a) availability of suitable Stand-by Product body at the respective Master Service Centers in which you have deposited your product for repair and

    (b) your undertaking in a prescribed format to return the Stand-by Product body to CIPL at the respective Master Service Center within such number of days as determined by CIPL, and in the event of any damage, loss or theft to/ of the Stand-by Product body or your failure to return the Stand-by Product body within the stipulated time, you shall be required to compensate/ indemnify CIPL for the losses suffered by CIPL due to the same , and CIPL’s decision in this regard including the amount / quantification of loss amount , which shall not be more that the MRP of the product given to you for use on returnable basis , shall be final and binding on you .

  • CIPL's current policy is to waive the first year membership fees under the program/scheme. You will have the option to continue or terminate your membership under the program/scheme before expiry / renewal of the membership which shall be on chargeable basis as determined by CIPL.
  • Any change in the details of your Registration Form must be promptly notified by you to CIPL. The extension of the membership under the program/scheme to any other Product that you may purchase after the commencement date of the Membership under the program/scheme will be at the sole discretion of CIPL. CIPL reserves the right to require you to provide additional documents or information in respect of any change in details that you notify to CIPL.
  • CIPL, CIPL’s parent company and any of affiliates/ Group companies of CIPL’s parent company, their employees/ officers (collectively, “CIPL Group Companies”) shall not be liable to you or any third party whosoever for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangibles losses (even if CIPL or CIPL Group Companies have been advised of the possibility of such damages) arising out of or in connection with (a) use or inability to use of services, supports or products or benefits to you under the program/scheme, (b) any act, omission or negligence of any technician, officer, employee or independent contractor of CIPL or CIPL Group Companies relating to the program/scheme, or (c) any other matter arising out of or in connection with the program/scheme or these terms and conditions.
  • You shall bear the risk and be responsible for all damage, injury or loss (including, without limitation, consequential loss, loss of profit, injury or damage) to yourself or others arising directly or indirectly out of or in connection with the service, support, delivery or use of the Products relating to the program/scheme . Any services or benefits to you under the program/scheme is provided on an “as is” basis, and CIPL expressly disclaims any warranty of condition, whether express or implied, including, but not limited to, warranty of merchantability and fitness for a particular purpose.
  • CIPL shall treat your personal data in accordance with CIPL's protocols, applicable laws and regulations and CIPL's latest privacy policy. The personal data supplied by you will be used for the purpose ("Purposes of Use") of:

    (a) maintaining CIPL's records relating to you and CIPL products;

    (b) operating the CIPL Club Elite Scheme and facilitating CIPL to provide you with benefits under the program/scheme;

    (c) sending you information relevant to Canon Products and services and other CIPL advertising and promotional materials;

    (d) determining/ communicating the amounts outstanding from you to CIPL (if any); and/or

    (e) any other purposes relating thereto.

  • You agree that CIPL may collect, use, disclose or transfer personal data which you have submitted in accordance with CIPL’s latest Privacy Policy. Without prejudice to the generality of the foregoing, you agree that CIPL may disclose/transfer such personal information to its, affiliates or sub-contractors, or to CIPL’s parent company, CIPL Group companies, or any of subsidiaries or affiliates of CIPL’s parent company or their subcontractors, and use or cause them to use such personal information for and in connection with the Purposes of Use. Your information may be stored and processed outside India and you consent to any such storage and processing of information outside India.
  • You have the right to (a) check whether CIPL holds data about you; (b) access any of your personal data held by CIPL; (c) require CIPL to correct any of your personal data held by CIPL that is inaccurate; and (d) ascertain CIPL's policies and practices in relation to personal data privacy. CIPL has a right to charge a reasonable fee for the processing of any personal data access request that you may make, if you have any requests for access to your personal data or for the correction of your personal data, or if you would like any further information regarding CIPL's policies and practices, kindly address your enquiries to CIPL.
  • You agree to hold harmless and indemnify CIPL, CIPL Group Companies, and their officers, employees, agents or partners from and against any damages, liability, claims, losses and expenses (including, without limitation, litigation costs and attorney’s fees) arising out of or in connection with your violation of these terms and conditions or any other acts or omissions in connection with the program/scheme.
  • Your Membership under the program/scheme shall not be construed as being granted by CIPL any authority to act for or represent CIPL or CIPL Group Companies. You shall not have any right to use any trade names, trademarks, logos and/or any other intellectual property rights of CIPL or CIPL Group Companies.s
  • A failure of CIPL to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision and shall in no way affect its right to later enforce or exercise it.
  • If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, you agree that it shall not affect the validity or enforceability of any other terms or rights which shall continue in full force and effect except for any such invalid or unenforceable provision or part thereof.
  • These terms and conditions set forth the entire understanding and agreement between you and CIPL, with respect to and in connection with the program/scheme.
  • These terms and conditions of Program/ scheme shall be construed and governed by the laws of India. You agree to submit to the non-exclusive jurisdiction of Delhi courts.
