Introduction:

The Canon customer relation management services (Program) is an initiative by Canon India Private Limited (CIPL) towards creating a photography culture. CIPL has started this initiative to enhance the experience of its esteemed Canon EOS Digital SLR cameras customer(s) who are Indian citizens, permanent resident of India and 18 years and above (Customers) with an objective to facilitate the Customers towards understanding the various functionalities of the Canon EOS Digital SLR cameras better.

The Customers who register on Canon Edge (edge.canon.co.in) provide their consent to Canon India Pvt. Ltd. to receive information on various Canon branded products, services, offerings, contests & any other promotional activity in accordance with the privacy policy as detailed herein below

By registering for this program, the customer agrees to the terms and conditions of the program.

Privacy Policy

This privacy policy/statement of CIPL (“Policy”) is made in relation to the Program offered/ provided by CIPL to its customers (“Services”) and specifies:

  • the kind of Information that CIPL will collect from CIPL’s customers (“Customers”), towards the provisioning of services by CIPL;
  • the use of the collected information by CIPL and any third parties appointed by CIPL towards the provisioning of the services; and
  • the security measures/ protocol that are adopted by CIPL to protect Customer Information collected for provisioning of services.

This Policy lays down the methods adopted by CIPL to collect and use Customer’s Personal Information, including the information shared by the Customer towards the program & services as well as other information captured by CIPL and other third parties appointed by CIPL through the network server hosted in India for provisioning of the services (“Information”).

Information Collected by CIPL

CIPL may collect Information, which is any information that identifies the customer and may include, but is not limited to:

  • Customer name and physical address, email addresses, telephone numbers and shipping information
  • Any image/photograph shared by the Customer for availing the Services
  • Payment information (including processing services related to credit card/debit card/internet banking but not Credit /Debit Card CVV number, any OTP generated during the internet banking transaction), to process the transactions in connection with the Services availed by the Customer
  • CIPL may store customer information in its server or the host server. Such information may be stored in the form of cookies so it can later be retrieved from that browser. Cookies may collect information, including user id and passwords, profile information, and general usage, and statistical information. CIPL may engage one or more third party service providers to track and analyze various statistical information on the usage pattern of the Customers from the Services availed by the Customer. The service provider(s) may set cookies to collect and process customer data in accordance with their respective privacy policy.

Information Sharing

CIPL and/or any third party service provider appointed by CIPL shall use and share the Information which are received in connection with the Services availed by the Customer (unless otherwise restricted by applicable law), to track and analyze various statistical information, Customer’s usage of the Services and for various other activities as set out below:

  • CIPL may use the Information in sending service related communications to the customer in connection with the service developments.
  • CIPL may use the Information to notify the Customer about new product releases and similar services, in accordance with this Policy. CIPL may pass the Customer’s contact information to the appropriate CIPL authorized dealers for further follow-up communications related to Customer’s interests on similar kind of Services.
  • CIPL may post Customer testimonials regarding the Services on various mediums such as social networking sites and corporate Website/Microsites. Prior to posting a Customer testimonial, CIPL will obtain Customer’s consent in writing to use the concerned Customer’s name and testimonial. If the Customer wishes to update or delete the testimonial, the Customer shall have to inform the CIPL Administrator in writing at delightingyoualways@canon.co.in.
  • CIPL may use Customer’s Personal Data/Information to help create and personalize Information received from the Customer to facilitate the use of the Services, improve quality, carry out promotional and marketing activities by online advertising, e-mail marketing and SMS campaigns, track marketing campaign responsiveness and evaluate response rates.

Marketing Activities

CIPL may engage in sales or product/service promotions. Both CIPL and any third party appointed by CIPL for providing the services may have access to Customer’s Information.  Either CIPL or its authorized dealers may provide the Customer with the product promotion information. CIPL shall be responsible for managing the use of the Customer Information collected for the sale and/or product promotion as per this Privacy Policy. The Customer shall review the privacy policy to address any questions they may have regarding CIPL’s handling of such information.

CIPL may disclose Customer’s Information as may be necessary or appropriate: (a) under applicable law, including laws outside Customer’s country of residence; (b) to comply with applicable legal process; (c) to respond to any subpoena/requests from Court and / or government authorities, including public and government authorities outside Customer’s country of residence, for national security and/or law enforcement purposes without taking any prior consent.

CIPL may use, transfer, and disclose customer’s information (including Personal data/information) that is collected for the  purpose of providing the services as well as for the purposes of its sales & marketing promotion, except where applicable law requires otherwise. If CIPL is required to treat any Information as Personal Information under applicable law, then CIPL will only use it in the manner as prescribed under applicable laws.


Storage of Information

CIPL may collect and store the Customer’s personal Information on the server that is hosted in India having security practices/ protocol as required under Indian law.

Cross Border Transfer of Information

CIPL shall ensure that Customer’s information is appropriately protected. Customer’s information may be transferred, accessed and stored globally as necessary for the use and disclosures as stated above in accordance with this policy. By providing the information, the customer consents to CIPL transferring such information including its Personal Information to CIPL affiliates/ Group Companies globally and to third party entities which support CIPL or that provide its services to CIPL for creation of customized Photo Album for the Customer.


Access, Correction, and Profile Updates

Customer may request CIPL to review, correct, update, or otherwise modify any of the Personal Information or to the use or process of any Personal Information that the Customer may have previously provided to CIPL for availing the Services by the Customer. The Customer shall have the ability to update their profile and related Personal Information at any time. To review, correct, update, or otherwise modify any of the Personal Information, the Customer shall write to CIPL at the following address: delightingyoualways@canon.co.in

In the request, the Customer has to clearly identify the Personal Information that the Customer would like to have changed in CIPL’s database.


Retention and Deletion

CIPL will retain Customer’s Information for as long as the Service is provided to the Customer for the purposes outlined in this Policy and for a period of 3 years thereafter at its discretion, except when it is necessary to hold for a longer period in order to comply with the applicable legal obligations, resolve disputes to the extent permitted by law.

At the end of the retention period, CIPL will delete the Information to ensure that it cannot be reconstructed or read.


Security

CIPL shall use reasonable physical, electronic, and administrative safeguards that are designed to protect Customer’s Information including the Images and Photographs shared by the Customer from the loss, misuse and unauthorized access, disclosure, alteration and destruction.

In addition, CIPL uses reasonable security protocols and mechanisms as prescribed under applicable laws to store/ exchange the transmission of Information.

Customer acknowledges that the information shared him for availing the services is solely at their own risk i.e. risk of loss/ misuse by any unauthorized entities. CIPL shall not under any circumstances be liable / responsible for any loss/ leakage of information / unauthorized access of such information to/by any third party.    

In the event that Customer’s Information along with other information is acquired, or is reasonably believed to have been acquired, by an unauthorized person/ entities and applicable law requires notification, CIPL will notify the customer by e-mail or postal mail. CIPL will give the Customer notice promptly as reasonably possible, consistent with the requirement under applicable law.

Information Shared by the Customer

Customer understands and agrees that all information, including Personal Information, photographs, images, graphics, messages, or other materials, howsoever shared, transmitted to, from or through any medium, is the sole responsibility of the Customer. CIPL does not approve as well as not responsible for any violative Content including but not limited to any infringed content that may violate any third party IP right, any content that contains antinationalistic character / intent , nudity, sexually graphic material, or material that is otherwise deemed explicit by CIPL, any image content that promotes incest and bestiality, content that promotes pornography, child sexual abuse, promotes hate toward groups based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity or threats of violence against any person or group of people and any content that are considered for spamming or transmitting malware and viruses. Further, the customer shall not submit or otherwise transmit any content that misleads or confuses any other user of the Website/Microsite including, but not limited to, encouraging another user to use the Website/Microsite in a way inconsistent with the terms and conditions, submit or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation.

WEBSITE USAGE TERMS AND CONDITIONS

  1. The Website contains forums and other interactive areas, and the customer agrees to use the Website/Microsite in a way that is proper and related to the Website/Microsite.
  2. In particular, the Customer agrees that when using the Website/Microsite the customer will:
    • Submit posts and replies in the forums that are relevant to the forum to which the customer is submitting, having regard to the name and description of the forum.
    • Use the Customer’s Self Account Section and pages within this section for the purpose of editing the information provided by the customer only and keep information which is relevant to the CIPL Website/Microsite.
    • Use the Customer’s Self  Account Section and pages in the event the Customer want CIPL to delete, dump the information provided by the Customer, subject to termination of Customer’s membership of the Website/Microsite
    • Submit images into the gallery that are relevant to the Website/Microsite and which have appropriate descriptive text. In furtherance thereto the Customer do not have any objection whatsoever for use of such images by CIPL, which CIPL may use at its sole discretion, with the customer name appearing therewith as the creator.
    • Have no objections whatsoever in receiving the updates, promotional emails, etc from the Website/Microsite from time to time after taking the membership of the Website/Microsite
    • Shall always log out the account completely by clicking the tab “Logout”, however in the event the same is not followed and certain data / information pertaining to Customer is lost, leaked, whatsoever, CIPL shall not be held liable for the same.
  3. The customer is prohibited from violating or attempting to violate the security of the Website/Microsite, including, without limitation, (1) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (2) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (3) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus or "Trojan horse" to the Website/Microsite, overloading, "flooding", "mail bombing" or "crashing", or (4) sending unsolicited electronic mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil or criminal liability. CIPL and / or its associate entities will have the right to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
  4. CIPL do not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Website/Microsite for any particular purpose. The customer acknowledges that such information and materials may contain inaccuracies or errors and CIPL expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

  5. The customer’s use of any information or materials on this Website/Microsite is entirely at customer’s own risk, for which we shall not be liable.

  6. The customer agrees to defend, indemnify, and hold harmless CIPL and/ or its associate entities, their officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Website/Microsite material or your breach of these terms and conditions of Website/Microsite use and the Privacy Policy. From time to time, this Website/Microsite may also include links to other Website/Microsites. These links are provided for Customer’s convenience to provide further information. They do not signify that CIPL endorses the Website/Microsite(s). CIPL shall have no responsibility for the content of the linked Website/Microsite(s).


Dispute Resolution:

If the Customer has any complaints regarding CIPL’s compliance with this policy, the Customer should first write to Eiichi Udagawa. CIPL will investigate and attempt to resolve complaints and disputes regarding use and disclosure of Customer’s information in accordance with this policy. All disputes or differences related to this policy shall be subject to the exclusive jurisdiction of Courts of Delhi and shall be governed by and construed in accordance with the laws of India.


Sensitive Information

Customers are advised not to send any Sensitive Information (such as Credit/Debit Card CVV number, any OTP generated during the transaction, government-issued or financial account numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, genetic, or biometric data).


Policy Updates

CIPL may update this Policy from time to time. In the event CIPL make material changes that diminishes Customer’s rights or CIPL’s obligations under this Policy, CIPL will post a prominent notice any such change in the Policy notifying the Customers when it is updated.


Quiz

  • Contest is live from 5th April 2.00 pm to 8th April, 11:00 am
  • The contest to have 1 winner, who will be shortlisted through an electronic lucky draw
  • Eligibility criteria for the lucky draw
    • All the 8 questions to be answered correctly
    • All 8 answers must be submitted within 2 minutes 40 seconds (20 seconds per question)
  • Only the 1st attempt will be considered for eligibility
  • In case no participant qualifies the above criteria mentioned in point 3, then the participants with the maximum number of questions answered correctly in the least time will be considered for the electronic lucky draw
  • Personal data collected via the quiz shall be used for ICP’s CRM activities & shall get regular CII updates
